TERMS & CONDITIONS – 2024 RETREAT

These are the Terms & Conditions that apply to Robyn Penner’s (the “producer”) clients hereafter “attendee” that attend events produced and presented by Robyn Penner. 

 

Payments: All bookings made prior to The Run Retreat must be paid in full to guarantee registration. Once payment has been received, an email confirmation and a receipted invoice will be sent. Payment must be received and processed by registration cut-off date. No bookings will be made without payment in full.

Early Bird Rate: To qualify for any “early bird” rates or discounts, booking and payment must be received before the deadline date listed in The Run Retreat marketing material. Rate may be subject to limited spaces.

Cancellation Policy: Our cancellation policy allows for a 100% refund for cancellations received in writing at least sixty (60) days prior to the first event date (April 7, 2024). No refunds will be made after this date. Transfers to another individual may be made up to 14 days prior to the first event date (May 25, 2024), however, it is the responsibility of the Attendee and the purchaser to set terms of payment, THE PRODUCER will not process any refunds. THE PRODUCER must receive the new Attendee’s full information 14 days prior to the first day of the event.

If a registered Attendee does not cancel and fails to attend The Run Retreat, this will be treated as a cancellation and no refund or credit will be issued. Should THE PRODUCER postpone an event or pivot from a live event to a virtual event, your registration will automatically roll over to the new date and platform. If an event is cancelled, a credit will be immediately issued for up to 12 months after the notification of event cancellation, to attend the next Run Retreat in 2025.

 

THE PRODUCER may (at its sole discretion) change the format (including, without limitation, from a physical in-person Event to a Virtual Event and vice versa), speakers, participants, content, venue location and programme or any other aspect of the Event at any time and for any reason, whether or not due to a Force Majeure Event (as defined below), in each case without liability. 

 

Speakers: Views expressed by speakers are their own. THE PRODUCER shall have no liability for advice given, or views expressed, by any speaker at The Run Retreat or in any material provided to attendees. 

 

Data Protection: By submitting registration details, delegates agree to allow THE PRODUCER and companies associated with The Run Retreat to contact them regarding their services. Delegates who do not wish to receive such communications please contact the events team. The contact details of registered delegates will be placed on the attendee list which will be passed to sponsoring companies and to all attendees for them to see who is at the Retreat for the purpose of potential marketing. Attendees who do not wish to be included on this list must so advise THE PRODUCER at the time of booking by emailing runtoretreat@gmail.com.

 

Websites & Links: The Run Retreat may link to other websites and networking tools provided for the convenience of the users. The contents of these websites are maintained by their owners, for which THE PRODUCER takes no responsibility. THE PRODUCER shall have no responsibility or liability for the contents of or use of information contained in any website linking to this website. 

 

Insurance: It is the responsibility of the Attendee to arrange appropriate insurance they may desire in connection with their attendance at the The Run Retreat. THE PRODUCER shall not be liable for any loss, liability or damage to personal property. 

 

Physical Activity: The Run Retreat involves sessions that have mild to moderate physical activity, including, but not limited to; walking, jogging, running, stretching, yoga, meditation and other activities. Attendee agrees that they are physically cleared to participate in the sessions and have consulted, if needed, with a doctor before participating. THE PRODUCER and any Speakers shall not be liable for any injury or death resulting from participating in The Run Retreat. 

 

Photographs, Publicity Material, Radio and Television and Print Media: THE PRODUCER reserves the sole right to use any photographs, recordings, electronic images or publicity material received by or obtained by THE PRODUCER in the course of the event, for whatever use deemed proper by the THE PRODUCER. THE PRODUCER has the exclusive right to include photographic, video and other visual portrayals of Attendees, Speakers, Sponsors and Staff, in any pictorial medium of any nature whatsoever for the purpose of advertising, sales, publicity and otherwise, without compensation. Attendees may be photographed and videotaped during The Run Retreat, if an Attendee does not wish to be photographed or videotaped please contact runtoretreat@gmail.com.

 

Accommodations: Attendees are responsible for their own accommodations. THE PRODUCER has secured a special room rate block for The  Run Retreat event at Hecla Resort for Attendees.  This rate is valid until May 7, 2024, after which time rooms are subject to availability and the hotel reserves the right to charge the current rack rate. All room fees, taxes and charges are the responsibility of the Attendee. Attendee is subject to any Hotel Terms and Conditions upon booking.

 

Meals: THE PRODUCER shall provide the Attendee with two dinners, two breakfasts, and one lunch. Any other meals, snacks or beverages or alcohol are the responsibility of the Attendee. THE PRODUCER will endeavour to accommodate dietary and allergy needs within reason.

 

Transportation: THE ATTENDEE is responsible for finding their own transportation to and from the event. THE PRODUCER is not responsible for providing any transportation. THE ATTENDEE will also be responsible for ensuring they have a valid Manitoba Provincial Park Pass for the duration of their visit/event.

 

Admittance: In its sole discretion and without refund, THE PRODUCER reserves the right to refuse admittance to or expel and Attendee from The Run Retreat that it determined to be behaving in a manner that could be disruptive to The Run Retreat or any other Attendee. Attendee consents and agrees that in such event, it shall not be entitled to a refund of any portion of amounts paid. 

 

While onsite, Attendee agrees to comply with any health and safety screenings, laws and regulations with regard to current public health guidelines, including but not limited to social distancing protocols, providing proof of full vaccination for COVID-19 and or negative COVID-19 test results, and face masks requirements. You acknowledge the health risk associated with the coronavirus (COVID-19) and any other viral outbreak, and the risk of exposure or infection by COVID-19 or any other virus. By attending the event in-person you acknowledge these risks and assume all associated liabilities. 

 

Disclaimer: THE PRODUCER may at any time, with or without giving notice, in its absolute discretion and without giving any reason, change, cancel or postpone The Run Retreat, change its venue or any of the other published particulars, or withdraw any invitation to attend. In any case, neither THE PRODUCER nor any of its officers, employees, agents, members or representatives shall be liable for any loss, liability, damage or expense suffered or incurred by any person, nor will they return any money paid to them in connection with The Run Retreat unless they are satisfied not only that the money in question remains under their control, but also that the person who paid it has been unfairly prejudiced, about which the decision shall be in their sole and unfettered discretion and, when announced, final and conclusive. 

 

Force Majeure: THE PRODUCER shall not be held responsible or liable for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, earthquakes, hurricanes, unseasonably extreme inclement weather, strikes, labor disputes, inability to secure sufficient labor, civil, governmental or military authority, government requisitions, restrictions or regulations on travel, facility availability, commodities or supplies, civil disturbance, transportation, acts of God, acts of terrorism or threats of terrorism, acts of war, accidents, epidemics, disasters, the unavailability of the Venue or any other cause beyond its reasonable control.  In any such event, THE PRODUCER may postpone, reschedule or cancel the event without liability on the part of THE PRODUCER.  In the event the Retreat cannot be held or is postponed pursuant to this section, THE PRODUCER shall not be liable to attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses.  

 

Interpretation: This Agreement shall be interpreted in accordance with the laws of the Province of Manitoba. Further, the Parties agree that all disputes and matters whatsoever arising under, in connection with or incident to this Agreement, shall be settled through arbitration conducted through an action brought in any court of competent jurisdiction in Manitoba, Canada, to the exclusion of the courts of any other province, territory, or country. In connection with any arbitration or litigation, the prevailing party will be entitled to recover reasonable attorney’s fees and costs.
